Unlike most states, North Carolina has a dual point system for traffic points. If you are found guilty of a traffic violation you can acquire DMV points and Insurance points. Most drivers realize insurance points are assessed by insurance companies who then add a surcharge to your insurance premium under the Safe Driver Incentive Plan.

You should always consult with an attorney regarding a ticket. Handled improperly, you will see that there can be serious financial consequences. DMV and Insurance points are counted against you for a three year period. Each driver in every household gets a โ€œwaiverโ€ for their first speeding ticket less than 10 MPH over the speed limit. If your insurance company raised your rate for a speeding ticket less than 10 MPH and it is your first one, please contact my offices and we will write a letter on your behalf.

3 Speeding more than 55mph
3 Failure to yield right-of-way
3 No driverโ€™s license/license expired more than 1 year
3 Failure to stop for siren
3 Driving through a safety zone
3 No liability insurance
3 Failure to report accident when required to
3 Speeding in a school zone
2 No child restraint/child not in seat belt
2 All other moving violations
1 Littering involving use of motor vehicle

No points are assessed for the offenses listed below:

  • Overloads
  • Over lengths
  • Over width
  • Over height
  • Illegal parking
  • Carrying a concealed weapon
  • Improper plates
  • Improper registration
  • Improper muffler
  • Improper display of license plate or dealerโ€™s tag
  • Unlawful display of emblems/insignias
  • No current inspection sticker

12 Vehicular manslaughter
12 Prearranged racing/knowingly lending a motor vehicle for a prearranged race
12 Hit-and-run (involving bodily injury/death)
12 Driving a commercial motor vehicle with a blood-alcohol level of .04 or more
12 Driving with a blood-alcohol level of .08 or more
12 Driving while impaired 12 Transporting illegal liquor for sale
12 Racing (not prearranged)/lending a motor vehicle to be used in a race
10 Speeding to elude arrest
10 Aggressive driving
8 Driving while license/registration revoked
8 Hit-and-run (property damage only)
4 Reckless driving
4 Passing a stopped school bus
4 Speeding 76+mph in speed zone of 70mph or less
